Terms and Conditions of Entry - ADOPT A FURBY

1. Information on how to enter form part of these Conditions of Entry for the “ADOPT A FURBY” Competition.

2. There is only one method of entry for this competition. To enter, entrants must log onto the ADOPT A FURBY page at the Nickelodeon website (www.nickelodeon.com.au) and either;

1) Register their Nick Name and Password by providing the following information; first name, last name, address, date of birth, whether they are a girl or a boy, their email address (optional); or

2) If the entrant has previously registered their details they are only required to enter their Nick Name and password in order to enter the competition.

3. Entry is open to kids aged 5 - 15 yrs as of 16.10.2005 who are Australian residents. Employees and immediate families of Nickelodeon Australia and agencies associated with this promotion are ineligible to enter.

4. The ADOPT A FURBY Competition commences from 16.10.2005 at 08:00am (EST). Entries close at 11:59pm (EST) on 12.11.2005. Entries received after the closing date will not be eligible to enter.

5. The competition is a random draw and will be drawn electronically.

6. The draw will be held at the Nickelodeon offices, Wharf 8, Pyrmont NSW 2009, at 12:00pm (EST) on 14.11.2005.

7. The first 10 valid entries drawn will each receive a Furby prize pack, each valued at $89.99.

8. Total prize value: 10x $89.99 = $899.90

9. The winners will be notified by mail.

10. Winners will be announced in the public notices of The Australian 14.12.2005. (30 days from first draw).

11. All reasonable efforts will be taken to contact prize winners. In the event of any unclaimed prizes, prizes will be distributed in accordance with directions given by relevant state authorities. A draw will be held to distribute any unclaimed prizes subject to any written directions given under Reg 37 of the Lottery and Gaming Regulations, 1993 (SA).

12. Redraw will be held at Nickelodeon Offices, Wharf 8 Murray Street, Pyrmont NSW 2009 at 12:00pm on 13.02.2006 (no sooner than 3 months from first draw).

13. No responsibility will be taken for late or lost entries.

14. Prizes are not transferable or redeemable for cash. The Promoter accepts no responsibility for any variation in the value of the prizes. The Promoter reserves the right to substitute any prize for an item of similar value – this is subject to state legislation.

15. The Promoter shall not be liable for any loss or damage whatsoever which is or may be suffered (including but not limited to indirect or consequential loss) or for personal injury which is or may be suffered or sustained, in connection with any prize, except for liability which cannot be excluded by law.

16. The Promoter reserves the right to use the winner’s name, voice, and likeness for advertising and publicity purposes in any media in perpetuity without additional compensation.

17. The Judge’s decision is final. No correspondence will be entered into.

18. All entries become the property of Nickelodeon Australia and may be used for promotional purposes. By entering the competition, each entrant consents to their personal information being entered on to a database.

19. Each entrant agrees all literary works, and all rights, title and interest associated herewith are unconditionally and irrevocably assigned to the Promoter. Each entrant warrants that all literary works submitted are original works of the entrant and does not infringe the rights of any third party.

20. The Promoter is Nickelodeon Australia Pty Limited ABN 99 627 643 021, Wharf 8 Pyrmont NSW 2009.
